Federal Judge Alvin Hellerstein died on Wednesday at the age of 92, leaving two of the most prominent legal battles in the country without a presiding officer. A spokesperson for the Southern District of New York confirmed the death, marking the end of a three-decade tenure that included oversight of the criminal prosecution of former Venezuelan President Nicolas Maduro and continued resistance to Donald Trump's efforts to relocate his New York state court case to federal jurisdiction.

Hellerstein assumed responsibility for the Maduro case in January, shortly after his 92nd birthday. He had been involved in matters connected to the former leader since 2014. His recent appointment drew some scrutiny following an incident where reporters observed him appearing to doze during the trial of a 32-year-old CEO convicted in a $175 million JPMorgan fraud case. Barry Pollack, an attorney for Maduro, expressed sadness over the news and offered condolences to the judge's family in a text message.

For Trump, Hellerstein served as a consistent procedural hurdle. The judge repeatedly rejected requests to move the former president's state criminal case, which resulted in a guilty verdict related to hush money payments to Stephanie Clifford, into the Southern District. In a recent ruling on August 28, Hellerstein reaffirmed his stance against presidential immunity claims, stating that the trial evidence did not infringe on such protections. He previously wrote that reimbursing Michael Cohen for hush money could not be considered the performance of a constitutional duty.

Hellerstein's career included oversight of litigation tied to the 2001 terrorist attacks, evidence of abuse at Abu Ghraib, and a federal suit involving a convicted sex offender. President Bill Clinton appointed him to the bench in 1998 when he was 64. His legal footprint also included a ruling against Trump's use of the Alien Enemies Act in a deportation case involving Venezuelans.

Legal experts suggest the judge's death will not automatically pause ongoing proceedings. Duncan Levin, a former federal prosecutor and lawyer, noted that there is no fixed period of delay. A new judge can review the existing paperwork and maintain or adjust current schedules. Levin emphasized that reading extensive case files is a core judicial skill, implying that the transition may proceed without major interruption to the trial calendar.
